Terms and Conditions Read each provision of this agreement carefully. By using our services, you accept the practices described in these Terms of Service. If you do not agree to the Terms, please do not use the services. The material on this website is protected by applicable copyright and trademark laws. You may not copy or modify the app, any part of the app, or our trademarks in any way. You may not attempt to extract the app’s source code, translate the app into other languages, or create derivative versions. The app itself, all trademarks, copyrights, database rights, and other intellectual property rights related to the app belong to Qick Mobility AB. Qick Mobility AB is committed to making the app as useful and efficient as possible. We reserve the right to make changes to the app and to charge you for its services at any time and for any reason. However, we will never charge you for the app or its services without notifying you in advance. This User Agreement and the Terms of Use (together, the “Agreement”) constitute a legally binding agreement between you (“you”, “your” or “user”) and Qick Mobility AB, doing business as Qick (“Qick”, “we”, “us”, or “our”). This Agreement sets out the essential terms governing your use of our services. For your use of the services, Qick requires that you (“you”) accept all terms and conditions of this Agreement, as applicable. “Agreement” means this Agreement. “Privacy Policy” refers to the privacy policy made available by Qick at https://www.Qickscooters.com/privacy “E-Scooter” means the electric Scooters rented out by Qick. “Scooters” means Qick’s E-Scooters. “Subscription” refers to the right to use the services either through a subscription-based purchase (e.g., monthly pass) or a fixed usage period (e.g., 24-hour pass), as described in more detail in the App. “Electric Vehicle” refers to Qick’s E-Scooters, mobility service, or similar shared mobility hardware rented from Qick. “Services” refers to the electric vehicle, the website, the Qick app, and related services described and made available through the website and app, together with other related equipment and information services. “Operational Area” means the areas defined and specified in the Qick app where the electric vehicle may be operated and made available. “Qick”: Qick Mobility AB, organization number 559120-6221, Skottvägen 26, 70369 Örebro, Sweden. “Qick App” means all proprietary Qick applications available via computer and mobile devices through which you can access the electric vehicles. “Website” refers to Qick’s website: https://www.Qickscooters.com We agree to rent the products to you in accordance with the terms of this Agreement. Unless otherwise stated, all monetary values mentioned in this Agreement shall be deemed denominated in Swedish Krona (SEK). 1. General Terms 1.1 Agreement and Parties You are the sole user of the services provided by Qick and are therefore solely responsible for complying with Qick’s terms and conditions. The parties to this Agreement are you and Qick. It is your responsibility to ensure that Qick’s property is used properly by you and by no one else. 1.1.2 Age Requirement You confirm that you are at least 18 years of age when accepting these terms. 1.1.3 Qick’s Property By accepting these terms, you agree to use Qick’s services — including the app, website, intellectual property, and E-Scooter — in a respectful manner. You agree to use the services only for their intended purpose. Furthermore, as a customer, you may not restrict or misuse Qick’s property by using its services for any purposes other than those intended by Qick. 1.1.4 Type of Service Qick provides an information and intermediation service, not a transportation service. Transportation services are provided by third-party providers (“Providers”) — independent drivers (either personally or through a company) acting as economic and professional service providers. By making a booking through the Qick app, you are legally entering into a binding transportation agreement with the Provider. Disputes arising from consumer rights, legal obligations, or applicable transportation laws must be resolved between the passenger and the driver. Our service offering is limited to acting as an intermediary between Providers and you (the passenger) who request such services. 1.2 Rental 1.2.1 You and Qick’s E-Scooter You are responsible for assessing your overall ability to ride, the weather conditions (such as slipperiness), any medical conditions, and other factors that may affect your ability to use Qick’s E-Scooters safely. The use of Qick’s E-Scooters must be carried out in a safe and respectful manner, which means you must consider various factors that could pose a risk to yourself or the public when riding. Please pay attention to the following factors: Speed Braking distance Weather conditions Your current riding ability By accepting these terms, you also confirm that you will not use the E-Scooter if it is defective. It is your responsibility as a customer to perform a safety check of the entire E-Scooter before use. Qick strongly discourages anyone from using an E-Scooter if a defect is detected. Qick also strongly encourages you to check the battery level before using the Scooter to ensure you can reach your destination. We advise against using an E-Scooter with a low battery level. If you detect a defect, you must notify Qick immediately. 1.2.2 Availability You agree that Qick’s E-Scooters are available only under good weather conditions. You also agree that, due to the nature of E-Scooters, they may not be available all day during the operating season. Availability is affected by various factors, including weather, seasonal changes, and force majeure that may impact Qick’s ability to provide its services. 2. Promotions and Payment 2.1 Qick Promotions Qick reserves the right to cancel or modify existing promotions or offers at any time. Qick credits cannot be used to purchase a Qick Pass. 2.2 Payment and Right of Withdrawal If you wish to exercise your statutory right of withdrawal, you must notify Qick in writing within 14 days from the date of purchase made through the app. You can exercise your right of withdrawal by contacting us via email at: support@qickscooters.com In the event of a refund of the remaining balance on the customer’s account, Qick reserves the right to withhold 10% of the amount, corresponding to the transaction fee charged to the company by a third party. 3. Your Responsibility 3.1 You Are Responsible for the Scooter You agree to be responsible for Qick’s property and to prevent any damage to it. In the event of damage to the Scooter, you agree to compensate Qick for the damage in accordance with the terms set out in this Agreement. You also agree to contact Qick immediately in the event of any damage, theft, or loss of Qick’s E-Scooter. 3.2 Improper Parking and Fees Qick Mobility reserves the right to charge a fee of up to 1,500 SEK if a municipality collects a misparked E-Scooter due to the user’s failure to park in accordance with our guidelines. To avoid this fee, the user must attach a photo at the end of the ride clearly showing that the E-Scooter is properly parked in a bicycle rack or other designated parking area for bicycles. According to applicable legislation, E-Scooters must be parked in bicycle racks or other designated areas intended for E-Scooters. Parking on sidewalks or other prohibited areas is strictly forbidden, and the municipality has the right to remove misparked Scooters. Qick Mobility may therefore charge the user a fee of up to 1,500 SEK if the municipality removes a misparked E-Scooter. 4. Use and Safety 4.1 User Responsibility You agree to be responsible for Qick’s property and to prevent any damage to it. In the event of damage to the Scooter, you undertake to compensate Qick for the damage in accordance with the terms set out in this Agreement. You agree to contact Qick in the event of any damage, theft, or loss of Qick’s E-Scooter. 4.2 Parking The rental period begins upon activation in the App and continues until the vehicle is deactivated. You may temporarily park the vehicle through the App; however, the rental period will continue during such pause. Qick may automatically end a ride after, for example, 60 minutes, in which case you are responsible for ensuring that the vehicle is properly parked. 4.3 Improper Parking and Fees Qick Mobility reserves the right to charge a fee of up to 1,500 SEK if a municipality removes a misparked E-Scooter due to the user's failure to park in accordance with our guidelines. Qick Mobility may therefore charge the user a fee of up to 1,500 SEK if the municipality removes a misparked E-Scooter. 4.4 Lost Vehicles Vehicles may not be locked, hidden, or otherwise concealed while inactive. A vehicle may be deemed lost or stolen if, among other things, its GPS is intentionally disabled or if the vehicle is moved after deactivation without an approved reason. Qick may take measures to recover the vehicle and, in cases of negligence or intentional misconduct, seek compensation for any resulting loss or damage. 4.5 Mobile Phone Holder and Use of Mobile Devices Any mobile phone holder provided on or together with the e-scooter is intended solely as a convenience accessory for holding a mobile phone during use. The user acknowledges and accepts that vibrations, uneven surfaces, impacts, speed, weather conditions, improper mounting, or other circumstances may cause the mobile phone to become loose, fall from the holder, or sustain damage. The Company makes no warranty or guarantee that a mobile phone will remain securely attached to the holder during use. The user is solely responsible for determining, prior to each ride, whether the holder is suitable for their mobile phone, ensuring that the phone is properly secured, and operating the e-scooter with appropriate care and caution under the prevailing conditions. The Company shall not be liable for any loss of, damage to, or other adverse effect on a mobile phone or other property resulting from the mobile phone becoming detached from, falling out of, or otherwise being affected by the use of the mobile phone holder. 5. Insurance Company and Deductible In the event of a claim reported to Qick Mobility’s insurance company, the customer is required to reimburse Qick Mobility for the applicable deductible of approximately 500 EUR, provided that the damage is covered by the insurance. 6. Privacy Policy Qick collects and processes your personal information in accordance with Qick’s Privacy Policy, available at: https://www.Qickscooters.com/privacy By accepting these terms, you consent to Qick’s collection and processing of your personal information in accordance with the Privacy Policy. 7. Updates to This Agreement Qick reserves the right to amend this Agreement at any time and without prior notice. Any such changes take effect immediately upon being published on Qick’s website or in the Qick app. It is your responsibility to regularly review this Agreement to stay informed about any modifications. By continuing to use Qick’s services after any such changes, you are deemed to have accepted the updated terms. 8.
